5. Disclaimer of Warranties

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice or conflict of law provision or rule. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Los Angeles County, California, and you hereby consent to the personal jurisdiction and venue in such courts.

You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
